Welcome to Validaide. As with all other online offerings, our services are delivered within a predefined privacy policy, as set out below.

 

 

The Validaide service is delivered to You by Validaide B.V. (hereinafter referred to as ‘Validaide’ or ‘We’), a Dutch corporation, with its registered office at Arthur van Schendelstraat 650, 3511 MJ, Utrecht, The Netherlands.

You agree that by registering, accessing and/or using the validaide.com web site and the data sharing software platform (“Platform”) that is included in the web site (the “Service”) you consent to the processing of your data as detailed below. You may withdraw your consent at any time by support@validaide.com, without affecting the lawfulness of processing based on consent before its withdrawal.

You represent that you have the power and authority to enter into the terms, conditions, obligations, representations and warranties set forth in this Policy.

If You are using Validaide as a representative of a company or legal entity, (i) You represent and warrant that you have the legal authority to consent to this Policy on behalf of that company or entity, and (ii) the terms “You” and “Your” in this Agreement refer to your company or legal entity consenting to this Policy as well as the individual consenting to this Policy on behalf of the entity.

 

 

DEFINITIONS

 

“Affiliate” means, with respect to any specified entity, any other entity that, directly or indirectly, controls, is controlled by, or is under common control with such specified entity. For purposes of this definition, “control” means the direct or indirect ownership of more than 50% of the voting securities or other ownership interests of an entity, or the power to direct the management and policies of such entity, whether through ownership, by contract, or otherwise

 

“Member Company” means a company or entity that is using the Service by means of one or more Registered User(s), either through a paid Subscription or free service.

 

“Personal Information” means personally identifiable information that we store and can be used to contact or identify you as described in Article 4 (1) of the Regulation (EU) 2016/679 of the European Parliament and the Council of 27 April 2016 (General Data Protection Directive) (“GDPR”). We may collect this information during the registration, activation and maintenance of your User Profile.

 

“Services” means any service made available to You through our web site or any usage or access instructions that we otherwise provide to You and which we may modify from time to time.

 

“Registered User” means an individual that belongs to a Member Company who is registered to access the Service.

 

“Usage Data” means information regarding Your use of the Service, such as information on the amount of storage resources consumed, as well as User and Location counts.

 

“User Profile” means Your profile information including full name, email and other Login Credentials, provided to us by You and updated by You periodically.

 

“Your Content” means any Content defined through the Service by You, or Your authorized users (or otherwise through Your account) such as User Profiles, Capabilities and materials uploaded. Your Content includes Your definition of Capabilities as defined and reviewed by You or Your authorized users, also when this was originally construed from Member Content that was shared with You by other Member Companies through our Service. Your Content does not include Usage Data.

1 Processing

  • Validaide processes your Personal Information in order to offer You our Services, to improve our Services and to make personal contact with You in case necessary. Validaide may employ Affiliates and third parties for the processing of your Personal Information.

  • You agree that Validaide processes your Personal Information and employs Affiliates and third parties for the reasons and in ways as described in this Agreement. In case of the employment of Affiliates and third parties, Validaide will be the Controller and the third party will be the Processor as described in Article 4 (7) and Article 4 (8) of the GDPR.  

  • In case of any questions, remarks or complaints regarding the processing of your Personal Information by Validaide, you can contact the customer support team by e-mail through support@validaide.com

 

2 Purposes of the processing

  • share Personal Information with other Registered Users, both within your Organization and with other Member Companies, to facilitate our Services; 

  • to provide the Services on our behalf; 

  • to monitor and report for internal business purposes; 

  • to assist us in the enhancement and improvement of our Service; 

  • in analyzing how our Services are used; or 

  • to fulfill any legal obligations. 

 

3  The personal data

  • Validaide processes the following personal data:

Mobile Phone - Optional

Job Title - Optional

Office Location - Optional

  • We gather your personal data in the following manners:

  • You may voluntarily provide us your Personal Information when using our Services; 

  • Your device may provide us with your personal data when using our Services; 

 

4 Basis of the processing

  • Validaide processes your Personal Information on the following legal bases: (i) your consent; (ii) the performance of a contract; (iii) compliance with legal obligations; and (iv) our legitimate interests or those of third parties, including SkyCell AG and its affiliates, in providing and improving our services, ensuring security, and conducting business administration, except where such interests are overridden by your interests or fundamental rights and freedoms. Where we rely on our legitimate interests or those of third parties (including SkyCell AG and its affiliates) to process your personal data, we have conducted a balancing test.  You have the right to object at any time to processing based on legitimate interests by contacting us at support@validaide.com

 

5 Sharing of your personal data

  • Validaide shares your Personal Information with Affiliates. Validaide also shares your Personal Information with third parties when necessary for the performance of the Services or to fulfill a legal obligation and with respect to the purposes as described above. 

  • Validaide currently shares your Personal Information with the following third parties.

  • Where we transfer your personal data to affiliates or third parties located outside the European Economic Area (EEA), Validaide ensures that such transfers are made in accordance with applicable data protection laws. Switzerland is recognized by the European Commission as providing an adequate level of data protection (Article 45 GDPR). Where required, Validaide implements Standard Contractual Clauses or other appropriate safeguards. 

  • Personal data is transferred to SkyCell AG and its Affiliates on the basis of legitimate interest and/or performance of contract. 

  • In order to guarantee that the third parties contracted by Validaide will treat your Personal Information with the same care and confidentiality, Validaide enters into a processing agreement with those third parties. â€‹â€‹

6 Security of your Personal Information

  • Validaide works hard to protect your Personal Information from unauthorized access, alteration, disclosure or destruction. In order to achieve this, Validaide takes appropriate technical and organizational measures that comply with today’s standards, such as:  

  • Our servers are firewalled and require encrypted logins to access; 

  • Servers and software is regularly updated to latest versions to fix security vulnerabilities; 

  • High risk vulnerabilities are patched as soon as identified and the patch is available; 

  • Any passwords we collect are stored encrypted and salted. 

 

  • When using an Affiliate or third party as described above, Validaide will enter into a processing agreement in order to make sure that this third party will guarantee the safety standards of Validaide.  

 

7 Retainment period

  • Validaide retains your Personal Information only for as long as is needed for legitimate business purposes (see “purposes of processing”) or fulfillment of a legal obligation. 

 

8 Your rights

  • You have the following rights regarding your Personal Information: 

a. Transparency and information regarding your personal data; 

b. Access to your personal data; 

c. Rectification or completion of your personal data ; 

e. Data portability; 

f. Erasure of your personal data; 

g. Restriction of processing of your personal data; 

h. Object to the processing of your personal data. 

i. Lodge a complaint with the supervisory authority in your country of residence, place of work or where the alleged infringement occurred 

  • Any request to information, access, rectification, completion, portability, erasure, restriction of processing or objection to the processing of your Personal Information can be send to Validaide, using the contact information below. You will receive a response within four (4) weeks. 

  • There might be circumstances under which Validaide is legally not allowed to meet your request. In such case, Validaide will notify you within four (4) weeks. 

  • In order to validate your personality, please attach a photo copy of your passport (without photo and social security number) to your request of objection letter. Validaide only takes in account requests regarding the personal data of the requestor.

9 Statistics, log data, and cookies

  • Validaide may keep track of user data of its Service for statistical purposes using third party services that collect, monitor and analyze data that your browser sends when using our Service (“Log Data”). This may include information such as your computer’s Internet Protocol (IP) address, browser type, browser version, the pages of our Service that you visit, the time and date of your visit, the time spent on those pages and other statistics. This data is anonymous and Validaide does not sell this information to third parties. 

  • In order to improve the experience of our Services we use cookies. A cookie is a simple text file that is stored on your computer or mobile device by a website’s server and only that server will be able to retrieve or read the contents of that cookie. Each cookie is unique to your web browser. It will contain some anonymous information such as a unique identifier and the site name and some digits and numbers. Cookies help provide capabilities such as remembering Your logged in status and analysis of usage to improve Your experience. 

  • You can remove the Validaide cookies, although it will lessen the experience of using our Service. To manually remove the cookies, search for validaide.com and www.validaide.com in your browser privacy settings. Highlight the cookies that are shown and press delete. This will remove the cookies from your machine until the point you visit Validaide again.
